Cumbrian Treasures Terms and Conditions

Activity” means the service or services that you have booked, i.e. Driver Guided Tour, Walking Tour, Workshop, Talk, Taxi Transfer, Coach Guide and includes all additional services that “We” (Cumbrian Treasures) has agreed to provide.

Written” means both paper and electronic communication.

Agreement:

When you have provided the information about the service you require, we shall send you a written confirmation of your order and price. Once we have received your reply agreeing to the Activity details and price proposed, we shall have a binding contract “Booking” for which we shall send an invoice.

Methods of payment:

We accept direct transfer and BACS. Payment by cheque is accepted but it must be cleared at least 7 days prior to the Activity.

Deposits:

We usually request a 25% non-refundable deposit to confirm a Booking.

Where this is the case, remaining balances must then be paid within 28 days before the day of the Activity for direct Bookings, or within 7 days for Tour Operators and Travel Agents.

If you wish to cancel:

If a confirmed Activity is cancelled by you, the following charges, plus any unrecoverable pre bookings will apply:

  • At any time: loss of 25% deposit.
  • Two weeks’ notice or less: loss of 50% of the total fee
  • One week’s notice or less: loss of 75% of the total fee
  • 72 hours’ notice or less: loss of 100% of the total fee.

Third party cancellations:

Cumbrian Treasures is not responsible for cancellations due to unscheduled closures by third party suppliers, or events beyond its control, but it will take all steps to offer an alternative.

The Weather:

We have no control over the weather, but unless there are exceptional circumstances or we believe conditions are too dangerous, Activities will go ahead if it is raining or windy. Clients are respectfully asked to bring waterproof clothing and wear good walking shoes where possible.

Changes to the itinerary by you:

In very exceptional circumstances, changes to the itinerary can be made upon the request of the client, involving more indoor activities such as museums, galleries, or stately homes. Should itineraries change upon the customer’s request, refunds for pre booked activities may not be possible and extra costs or entrance fees may be incurred.

Changes to the itinerary by us:

If We consider that changes to the itinerary need to be made or you should not try to do a specific Activity due to circumstances out of our control (for example because of unexpected adverse weather) and there is no mutually agreeable alternative Activity, we can either reschedule the activity to a different date or you may request a full refund of any monies paid for guiding services.

If We are unable to undertake the Activity due to personal circumstances:

We will always try to find a replacement Blue Badge Guide/ Driver Guide to fulfil the Activity. If this is not possible we will see if the activity can be arranged to an alternative mutually agreeable date. If this is not possible and We have to cancel the Activity, a refund of any money you have already paid will be reimbursed to you, however, We shall have no other liability to you of any sort.

If there are problems during the Activity:

In the event of mechanical breakdown, illness, or other problems during the Activity, We will decide whether to cancel the rest of the Activity, to wait for and use a replacement vehicle, or to vary the Activity details.  We will have no liability to recompense you for cancellation or changes to the Activity details, however in the case of irreparable breakdown where safety is paramount, We will make arrangements to transfer you back to your pick up point.

Non-UK conditions:

Our cancellation policy will not be varied to accommodate clients who cancel Activities because of conditions prevailing outside the UK. Such costs should be recovered from clients’ Travel Insurer.

Cancellations due to Covid:

Bookings cancelled at short notice because of Covid will still be payable as per the cancellation charges above. (This should be reclaimed through your travel insurance).

The Blue Badge Driver Guide Association recommends against taking guests who test positive in the enclosed space of a vehicle.

We strongly recommend that all clients have suitable travel insurance to cover any losses that may arise from cancellations.

Safety of Our Clients:

For safety, all passengers are required to be seated whilst the vehicle is in motion and use the fitted seat belts.

We have an obligation to all Our clients to keep them safe. This means that We may need to exclude people from Our vehicle in the event of inappropriate behaviour or other difficulties, and We therefore reserve the right to do so.

Liability:

Cumbrian Treasure is not liable for any loss, accident, injury or damage to clients and their personal effects.

Personal health and fitness:

If your trip involves any activity which involves physical exertion in the form of a walk there is an inherent risk of personal injury. It is your responsibility to ensure that you can cope with the level of physical activity involved. If you have any medical conditions, please consult a doctor before booking. We will always try and gain an understanding to levels of fitness and mobility and adapt Activities to your needs. Sometimes we may have to amend our itinerary if we feel that you may be unable to cope with something or that you will be putting yourself under unnecessary risk.

Changes to the Journey:

You will receive a copy of our agreed itinerary and timetable on booking. On the day of the Activity, a copy of the agreement will be given to you. These are always subject to external events (for example weather or road closures) which are beyond Our control. If you need any changes on the day, or if any changes prove to be necessary, We will do Our best to accommodate them but reserve the right to charge you extra if additional costs are incurred.

Special requests:

We will aim to meet any reasonable requests including dietary and mobility requests providing we are informed prior to our Activity. Complying with these requests is not always possible and Cumbrian Treasures cannot be held responsible for any unreasonable requests. Sometimes there may be an extra charge to meet unusual requests which are out of the ordinary.

Flexibility & timekeeping:

Our tours aim to be as flexible as possible to accommodate your needs on the day. Full day Tours will usually last at least 7 hours from collection to drop off. If you arrive at a meeting time late or are not ready to leave at an agreed time the tour will still finish at the agreed time.

Gratuities & Tips:

Service charges are not included in our fares, and any gratuities for the driver are at the customers’ discretion.

Photography:

Unless specifically asked not to, Cumbrian Treasures reserves the right to use any photos taken during our activities to be used in promotional materials, on our website or social media.

Travel Insurance:

We consider adequate travel insurance to be essential. We are not responsible for any medical expenses or for any costs, loss or damage suffered by you because of illness or accident.

Pets:

Pets unfortunately cannot be accommodated on our Activities.

Refreshments and entrance fees:

These are not included within Activity costs unless specifically stated. The customer is liable for their own lunch/refreshment costs and admission fees to third party venues, e.g. heritage properties, exhibitions, and galleries.

The contract:

By placing a booking with us, you are confirming that you have read, fully understand, and agree to these Terms & Conditions.
